Wayne Elliott has had a wild week.

On Monday night, he wore the white hat as the referee of the crew that bungled the Seahawks-Packers game.? On Friday night, Elliott worked a high school football game.

In the interim, Elliott says his phone has been ringing with calls from angry fans, telling him he should ?commit suicide? and that he ?should die.?

But he still believes it was the right call.

?The replay guy just said there is nothing here that we can use to overturn it. It?s going to stand,? Elliott told FOX7 in Austin.? (This confirm that, when it came to replay reviews during the lockout, non-replacement replay officials were actually usurping the authority of the on-field referees.)

As we recently explained, via the NFL?s rulebook and casebook, there was enough evidence to overturn the ruling on the field, because Packers safety M.D. Jennings had ?control? of the ball before Seahawks receiver Golden Tate, which is the key factor regardless of what happens as they land on the ground and wrestle for the ball.? (Sorry, Seahawks truthers, but that?s the truth.)

Elliott also said he has ?no regrets? about accepting the assignment as a replacement, and that it was ?the most fun I?ve ever had.?

It was the most fun he?s had because he has been working as an official at the lower levels of the sport since 1978.? The fact that he hadn?t risen to the NFL or to a high-end college conference in the past 34 years tells us all we need to know about his overall skills.? As we?ve said time and again, if the replacements were among the best of the best, they would have been among those who were locked out.

Elliott declined to apologize to the fans of the Packers, explaining that if the call had gone the other way people would be asking if he should apologize to the Seahawks fans.

Scheduled to work the Vikings-Lions game in Week Four, Elliott said he wanted to ?get the bad taste out of his mouth? from Monday night?s game ? you know, the one for which he has nothing about which to apologize.

Republicans Fire Their Voter-Registration Firm

Republicans have fired the firm they had employed to register voters in battleground states.

After Florida election officials said they received faulty voter-registration forms, the Republican National Committee said it had severed ties with Strategic Allied Consulting, a voter-registration firm that was handling GOP registration efforts in Colorado, Florida, Nevada, North Carolina, and Virginia - all key swing states in the presidential election.

"We have zero tolerance for any threat to the integrity of elections," said RNC communications director Sean Spicer. "When we were informed of an alleged incident, we immediately cut all ties to the company."

Voter fraud has long been a charge conservatives have lodged against Democrats. During the 2008 election cycle, Republicans accused the since-disbanded group ACORN of falsifying forms.

An RNC official downplayed the notion that parting ways with Strategic Allied Consulting will damage the RNC's registration push, saying the Republican registration effort "was wrapping up anyway" by the time faulty registrations were discovered.

The five states where the dismissed firm was working were the only ones in which the RNC had organized voter-registration efforts, the official said. He described Republicans' registration push as far more limited than Democrats'.

The firm, recommended by the RNC to state parties, was contracted both by the RNC and by the five state parties, which also have severed ties, according to the RNC. The RNC had been funding the registration efforts.

Election officials in at least seven Florida counties told the Associated Press - and prosecutors and state officials - that they had received faulty forms, including some that listed dead people. The Republican Party of Florida had already fired the firm, according to the Associated Press, which reported that Strategic Allied Consulting said it suspected the forms were submitted by one person, who has been fired.

Competitive Senate races are unfolding in two of the states: ABC News rates Senate contests in Nevada and Virginia as toss-ups. ABC News rates Florida's Senate race as "leans Democrat," with Sen. Bill Nelson expected to win re-election.

Living with pets in small spacesLiving in an apartment, town home, or small house with no yard does not mean you can?t properly care for a dog or cat. Even large animals can adapt to small spaces, and cats and dogs can get plenty of exercise in urban areas. It might take a little more effort on your part, though, if there?s no yard for romping and roaming.

Before you adopt a pet for your small space, research the exercise requirements for that particular breed. This is especially important if you plan to adopt a dog. Some breeds do require a yard for regular exercise, and daily trips outside on a leash won?t be enough to satisfy these pets.

Dog Parks and Runs

Most cities have one or more dog parks or dog runs designed to keep animals safe and confined while they get exercise. Check your local phone book or ask your veterinarian for dog parks near you. Remember to check out the rules of every dog park you visit; some parks may not allow all breeds, while many have strict policies prohibiting sick dogs, aggressive dogs, and dogs in heat.

Take Your Dog for a Walk

Take your dog for one or two good walks every day, even if he has a place near your home to do his business. Walking is good exercise and stimulation for your pooch. If you work long hours or are unable to take your dog for frequent walks for another reason, consider hiring a dog-walker to come by once or twice a day.

Schedule Play Dates or Consider Doggie Daycare

Dogs benefit from social interaction as well as physical activity. If a friend or neighbor has a dog that gets along with your pooch, schedule a few dates each month for them to get together and play. Activities such as tug of war require little space, are very physically challenging, and are most fun when played with a friend. Another option it to find a doggie daycare in your area that allows free play with other animals. Call around until you find one you like, but remember to check it out thoroughly before trusting the facility with your pet.

What about Cats?

Cats are easier to entertain at home and require considerably less space than dogs. Cats living in small spaces will benefit most from interactive cat?toys, such as dangling feathers and motion-activated mice. Treat balls are great because they stimulate your cat mentally and physically. Make sure you also provide scratching posts, climbing trees, and towers for your cat to perch on.

Bursts of energy known as relativistic jets spew out matter at close to the speed of light. These jets can travel across an entire galaxy, suggesting they can affect the evolution of the galaxy.

"For a long time, astronomers have theorized that?black holes?and the matter swirling around them were responsible for the jets we see in some galaxies, but we've never had a telescope with the resolving power to verify this,"said study lead author Sheperd Doeleman, an astronomer at MIT's Haystack Observatory in Westford, Mass.

Now, "by making a virtual Earth-sized telescope that links radio dishes from Hawaii to California, we were able to achieve the necessary magnification power," Doeleman told SPACE.com. [Photos: Black Holes of the Universe]

The researchers used their new array, known as the?Event Horizon Telescope, to look at "the base of the famous jet in the galaxy called M87," about 54 million light-years from Earth, Doeleman said.

The center of virtually every galaxy is home to a?supermassive black hole?millions to billions of times the mass of the sun. Scientists have long suspected that relativistic jets came from the accretion disks of gas and dust pulled toward these black holes by the black holes' immense gravity, whirling like water flowing around a bathtub drain.

The new array combined data from three observatories in Hawaii, California and Arizona to look at the?relativistic jet in M87, which has a central black hole about 7 billion times as massive as the sun and about as wide as the solar system.

The size of the region the relativistic jet originated from matches the estimated size of the innermost stable circular orbit of M87's accretion disk. This area is about five times the size of the solar system, or 750 times the distance from Earth to the sun.

"It is remarkable to me to think that we have the ability to measure the size of the region where matter orbits a black hole just before it disappears from our universe forever," Doeleman said.

Scientists were unsure whether relativistic jets need a spinning black hole to form, and if so, whether they were more likely to arise when accretion disks spin in the same direction as their black holes. The researchers found "the size of the jet launch point was so small that the best explanation is that the black hole has to be spinning and the orbiting matter has to be moving in the same direction as the black hole is spinning ? think of the planets orbiting in the same direction as the sun is spinning," Doeleman said.

"Our result is just the tip of the iceberg," Doeleman added. "We've used just three stations in a global Earth-sized virtual telescope to peer deep inside a relativistic jet. We are about to add critical new stations to this Event Horizon Telescope, which will bring us closer to imaging a black hole boundary than we have ever been before."

The scientists detailed their findings online today (Sept. 27) in the journal Science.

Parallel computing is normally reserved for supercomputers way out of the reach of average users -- at least at the moment, anyway. Adapteva wants to challenge that with its Parallella project, designed to bring mouth-watering power to a board similar in size to the Raspberry Pi for as little as $99. It hopes to deliver up to 45GHz (in total) using its Epiphany multicore accelerators, that crucially, only chug 5 watts of juice under normal conditions. These goliath speeds currently mean high costs, which is why they need your funds to move out of the prototype stage and start cheap mass production. Specs for the board are as follows: a dual-core ARM A9 CPU running Ubuntu OS as standard, 1GB RAM, a microSD slot, two USB 2.0 ports, HDMI, Ethernet and a 16- or 64-core accelerator, with each core housing a 1GHz RISC processor, all linked "within a single shared memory architecture."

An overriding theme of the Parallella project is the openness of the platform. When finalized, the full board design will be released, and each one will ship with free, open-source development tools and runtime libraries. In addition, full architecture and SDK documentation will be published online if-and-when the Kickstarter project reaches its funding goal of $750,000. That's pretty ambitious, but we're reminded of another crowd-funded venture which completely destroyed an even larger target. However, that sum will only be enough for Adapteva to produce the 16-core board, which reportedly hits 13GHz and 26 gigaflops, and is expected to set you back a measly $99. A speculative $3 million upper goal has been set for work to begin on the $199 64-core version, topping out at 45GHz and 90 gigaflops. Pledge options range from $99 to $5,000-plus, distinguished mainly by how soon you'll get your hands on one. Big spenders will also be the first to receive a 64-core board when they become available. Europe looks to start fast, quiet Ryder Cup crowd

MEDINAH, Ill. (AP) ? Any notion the Ryder Cup is some friendly contest, a better version of a country club scramble, ended when Jose Maria Olazabal announced his first two pairings.

Rory McIlroy, the world's No. 1 player, and Graeme McDowell, who delivered the winning point at Celtic Manor two years ago, will start Europe off Friday morning at Medinah. Then comes Luke Donald and Sergio Garcia, neither of whom has ever lost a foursomes match.

Win those two matches, and the Americans might never recover.

"We're trying to win points. Period. That's it," Olazabal said Thursday afternoon. "We have to go for it. We are playing away. The crowds are going to be on their side. They set up the course to their liking. So you have to make a bunch of birdies out there to win points. Just send the best players out there."

Fourballs will be played in the afternoon.

Ryder Cups are all about momentum, and the Europeans have had most of it for the last 15 years. They've won four of the last five meetings, and six of the last eight.

On paper, the Americans and Europeans are just about equal, two of the strongest teams in the event's 85-year history. All 24 players are among the top 35 in the world ranking, the first time that's happened. All 12 Americans were in the 30-man field at last week's Tour Championship, joined by five of the seven Europeans who were eligible. Europe has four major champions, and four players who have been No. 1 in the world.

But the Americans have the fans on their side, and the players are eager to feed off their enthusiasm. Any contest that invokes pride in country or continent is a rowdy affair, and there is nothing that gets American fans revved up more than athletes who wear U-S-A on their chest. (Or golf bags, in this case.)

"We need their energy to get us to play our best golf, and we need to play our best golf to beat a very tough European team," Phil Mickelson said.

Put a couple of quick blue points on the board, however, and that home field advantage disappears.

"Tomorrow's morning session is hugely important, and Jose Maria has stressed that," McDowell said. "We know they are all important, but we really feel that it is very important to make a fast start."

It doesn't start much faster than that first pairing. McIlroy is the hottest player on the planet, with three wins in his last five events, including his second major at the PGA Championship. He and McDowell, one of his closest friends on or off the course and a major champion himself, are 1-1-1 when paired together ? though they did lose their only alternate-shot match in 2010.

They'll face Brandt Snedeker and Jim Furyk. Snedeker is one of the four U.S. rookies, and he talked the other day of needing to calm down because he was so excited for the Ryder Cup. But he's playing almost as well as McIlroy, and he's fresh off the biggest payday in golf with his two-fer last weekend in Atlanta: the Tour Championship and FedEx Cup titles.

"We weren't guessing who was going to be there. We were guessing what it was going to sound like, feel like and who could handle that the best," U.S. captain Davis Love III said. "And the more you get to know Brandt Snedeker, the more you'll understand why he's going off first."

Garcia, who missed the 2010 Ryder Cup while mired in a slump, is one of the best foursomes players in Ryder Cup history. He's 8-0-1, the one halve coming in 2008 when he was paired with Lee Westwood. He's 4-0 when paired with Donald in alternate-shot matches, and they've handled some of the best the U.S. could throw at them, including Furyk and Tiger Woods, and Phil Mickelson and David Toms.

They'll face Mickelson and rookie Keegan Bradley this time.

"It's not a pairing that surprises you because they play a lot of golf together and know each other very well," Donald said. "But we've had some success against Phil before, and hopefully we can again tomorrow."

The third pairing features Jason Dufner, another U.S. rookie, and Zach Johnson against Lee Westwood and Francisco Molinari. Love saved his best team for last, sending out Steve Stricker and Tiger Woods, who are 6-2 together in the Ryder Cup and Presidents Cup. They'll face Ian Poulter and Justin Rose.

Poulter is 8-3 in the Ryder Cup, though two of those losses were to Woods in team matches. Both of those matches were fourballs, where Woods has a stronger record.

"We've had some pretty good success over the years, and we both have been playing well," Woods said. "Our captain said that would be a good fit, and he wanted us out there to anchor."

Both captains said all week the tough part would be figuring out who to leave out. Olazabal elected to bench Paul Lawrie, Martin Kaymer, Peter Hanson and Nicolas Colsaerts, the only rookie on Europe's side. Love sat out the pairing of Webb Simpson and Bubba Watson, and Dustin Johnson and Matt Kuchar.

"I won't make any predictions, but I can tell you this: I love my team and I love the pairings," Love said. "I love the plan we've got going, and I'm excited to watch them go play."

Genetic sleuthing uncovers deadly new virus in Africa

ScienceDaily (Sep. 27, 2012) ? An isolated outbreak of a deadly disease known as acute hemorrhagic fever, which killed two people and left one gravely ill in the Democratic Republic of Congo in the summer of 2009, was probably caused by a novel virus scientists have never seen before.

Described this week in the open-access journal PLoS Pathogens, the new microbe has been named Bas-Congo virus (BASV) after the province in the southwest corner of the Congo where the three people lived.

It was discovered by an international research consortium that included the University of California, San Francisco (UCSF) and University of California, Davis (UCD), Global Viral, the Centre International de Recherches M?dicales de Franceville in Gabon, the Institut National de Recherche Biom?dicale, Kinshasa in the Democratic Republic of the Congo, Metabiota and others.

"Known viruses, such as Ebola, HIV and influenza, represent just the tip of the microbial iceberg," said Joseph Fair, PhD, a co-author and vice president of Metabiota. "Identifying deadly unknown viruses, such as Bas-Congo virus, gives us a leg up in controlling future outbreaks."

"These are the only three cases known to have occurred, although there could be additional outbreaks from this virus in the future," said Charles Chiu, MD, PhD, an assistant professor of laboratory medicine at UCSF and director of the UCSF-Abbott Viral Diagnostics and Discovery Center, who spearheaded the UCSF effort to identify the virus. Chiu and his team continue to work on new diagnostics to detect the virus so that health officials in Congo and elsewhere can quickly identify it should it emerge again.

One odd characteristic of the Bas-Congo virus, Chiu said, is that while a number of other viruses in Africa also cause deadly outbreaks of acute hemorrhagic fever -- Ebola virus, Lassa virus and Crimean-Congo Hemorrhagic Fever virus to name a few -- the new virus is unlike any of them.

Genetically it is more closely related to the types of viruses that cause rabies, which are known to infect people with a very different sort of disease -- a neurological illness that is uniformly fatal if untreated but may take months to develop.

An antibody test developed in this study was applied to the one patient who survived and to others who had come into contact with him. It suggested that the disease may be spread from person to person but likely originated from some other source, such as an insect or rodent.

The identity of this animal "reservoir" and the precise mode of transmission for the virus remain unclear and are currently being investigated by Metabiota and the central African members of the consortium through the PREDICT Project of USAID's Emerging Pandemic Threats Program. How the New Virus Emerged

In the summer of 2009, a 15-year old boy in a small rural community called Mangala village suddenly fell ill and developed a bleeding nose, bleeding gums and bloody vomit. He rapidly worsened, dying within three days of the first signs of illness.

A week later, a 13-year old girl who attended the same school and lived in the same neighborhood as the boy came down with a similar, serious illness. She declined just as rapidly and also died within three days. One week after that, the male nurse who cared for this girl began showing the same symptoms, and he was transferred to a hospital in Boma, a nearby port city that sits along the Congo River upstream from Africa's Atlantic coast.

Members of the consortium, who had initiated a project to diagnose unusual cases of severe hemorrhagic fever, obtained blood samples collected from the nurse by the Congolese doctors and sent them to the laboratory of Eric Leroy, PhD, doctor of veterinary medicine at the Centre International de Recherches M?dicales de Franceville in Gabon. There the samples were tested for traces of any known virus, but nothing was found. The Metabiota scientists then solicited the expertise of Chiu at UCSF and Eric Delwart at the Blood Systems Research Institute (BSRI) in San Francisco to aid in the diagnosis.

The researchers ultimately identified a completely new virus as the cause of the mysterious illness through a powerful strategy for identifying novel pathogens known as "deep sequencing," in which millions of DNA sequences are generated from a clinical sample and then pieced together using computer algorithms combined with human analysis.

Distinct Attributes of Bas-Congo

The Bas-Congo virus belongs to a family of viruses known as the rhabdoviruses, a large family of viruses that infect plants, insects and mammals, including humans. The most famous member of this family is the virus that causes rabies. But even among the rhabdoviruses, Bas-Congo is something of an outlier, being very genetically distinct from other members of the family.

What's most unusual about this virus, though, said Chiu, is what it does to people.

No other rhabdoviruses are known to cause the acute, rapid and deadly hemorrhagic fever seen in the three cases in the Congo. Rabies, for instance, can be a deadly disease if untreated, but the course of rabies in humans is nothing like the rapid and deadly onset seen with the Bas-Congo virus. There is some precedent, however, for hemorrhagic disease from rhabdoviruses in the animal kingdom: fish rhabdoviruses are known to cause hemorrhagic septicemia -- acute bleeding and death -- in affected fish.

The third patient had enormous amounts of BASV in his bloodstream just two days after he fell ill -- more than a million copies in every milliliter of blood.

The BASV sequence was also used to design an antibody test for the virus, an effort led by Graham Simmons at the BSRI, another member of the consortium. Antibodies are blood immune proteins produced in response to an infection. The antibody test allowed the researchers to screen both the third patient with acute hemorrhagic fever and other people who had come into contact with the third patient, including the nurse who cared for him in the Boma hospital. High levels of BASV-specific antibodies were found in the third patient, establishing that he indeed had been infected with Bas-Congo virus. The same antibodies were also found in the second nurse, even though he never actually became sick.

"What this suggests is that the disease may be transmissible from person to person -- though it's most likely to have originated from some other source," said Nathan Wolfe, PhD, founder and chairman of Global Viral, and a co-author on the paper. "The fact that it belongs to a family of viruses known to infect a wide variety of mammals, insects and other animals means that it may perpetually exist in insect or other 'host' species and was accidentally passed to humans through insect bites or some other means."

The research consortium includes San Francisco-based Global Viral, Metabiota, UCSF, BSRI, as well as researchers with the Centre International de Recherches M?dicales de Franceville in Gabon; the Institut de Recherche pour le D?veloppement in Montpellier, France; the Institut National de Recherche Biom?dicale, Kinshasa in the Democratic Republic of the Congo, the University of Texas Medical Branch in Galveston, TX; the University of California, Davis; the University of California, Los Angeles; Stanford University; and the Howard Hughes Medical Center.

Police: Drunken man on horse arrested after chase

BUNNELL, Fla. (AP) ? A man was intoxicated while riding his horse as he led police on a half-hour chase through a northeast Florida town, authorities said Tuesday.

Charles Larkin Cowart, 29, was arrested Monday afternoon in the city of Bunnell, about 60 miles south of Jacksonville.

A police officer was responding to a report of "an intoxicated male riding a horse" when he turned on his emergency lights to stop traffic as Cowart crossed the street, according to the charging affidavit. Cowart said he was on his way to his grandmother's house in nearby Flagler Beach, but refused officers' order to dismount and "in an aggressive manner reared the horse back" and took off running.

Officers did not immediately chase after him, the report said, citing the public and the horse's safety. Cowart continued to ride through town, "causing a crowd of people to come out of their homes" and a train to slow down as Cowart crossed over a set of railroad tracks. Police kept their emergency lights on, but did not use their sirens to prevent the horse from being frightened and "potentially making the situation worse."

Cowart ignored several verbal commands to get off the horse, which after more half an hour, became exhausted. Cowart eventually jumped off and took off running. He was captured a short time later. The horse returned to Cowart's family and is doing fine, police said.

Cowart was booked into the Flagler County Jail on charges that included disorderly conduct, resisting arrest without violence and cruelty to animals. He was being held Tuesday on $7,000 bond.

A message was left Tuesday at a phone listing for Cowart in Bunnell, about 60 miles south of Jacksonville. It was not immediately known if he has an attorney.

Cowart was arrested for petit theft on Sept. 9 and on a DUI charge in October 2010. The disposition of those charges wasn't immediately known.

"Cloud Atlas" getting IMAX release

LOS ANGELES (TheWrap.com) - "Cloud Atlas," the sprawling science fiction epic from the makers of "The Matrix" trilogy, will unfold on IMAX screens, Warner Bros. said Monday.

The film, which features Tom Hanks in a hideous '70s-era comb over and beige turtleneck sweater, as well as Hugo Weaving in drag, tells several interwoven stories of love, hope and rebellion across many eras. It co-stars Halle Berry and Hugh Grant and was directed by the Wachowskis ("The Matrix") and Tom Tykwer ("Run Lola Run").

"Cloud Atlas" will be digitally re-mastered for IMAX screens and released in the format on select North American screens on October 26, 2012.

"Cloud Atlas" proved to be one of the most divisive films at the recent Toronto Film Festival, with some branding it pretentious and plodding, and others critics hailing its bold visual style and narrative ambition. TheWrap's Steve Pond acknowledged that the film would have its detractors, but implied it was worth the price of admission.

"Warners may be able to sell the movie on the basis of stars like Tom Hanks, Halle Berry and Hugh Grant, but the film is bound to be divisive, and I fully expect some reviews to be savage," Pond said. "But for my money, any movie that finds me filling a page in my notebook with a litany of adjectives that includes messy, incomprehensible, glorious, silly, pompous, fun, wonderful, ludicrous and spectacular makes for three hours well spent - even if at times during those hours I wondered why I'd gotten up early."

One of fitness.com's most fit celebrities that we just can't get enough of, has to be Ryan Reynolds.? So, what can we not help but bring you?? More information on this hot muscle ...

Lately you could find Ryan?Reynolds.....or could you? Reynolds just finished filming one of the greatest suspense movies he has ever played a role in, where he spent the majority of the time cooped up in a wooden coffin. The film is called "Buried", and the story is about a man (played by Reynolds) who is a United States truck driver in Iraq, that gets himself trapped in a coffin. All he has access to in the outside world while being trapped in the coffin is a cell phone and a lighter.

Reynolds says the role took an incredible toll on him both physically, and emotionally. He says it was an experience unlike no other. It really brought the reality of war to him, and he said that for him "the scars and things, are just spoils of war." After spending 17 hours in the coffin, Reynolds may have come out of the box with a lot of bruises, scrapes, and even a little bald patch; but Reynolds calls his physical injuries from the film making "souvenirs."

As for his mental health, which may have suffered more than his physical; he found it hard to get back into the normal routine of every day life without feeling the jitters. Since being stuck for 17 days straight while filming, Reynolds claims that he had more anxiety and sense of panic than he had ever felt before, and had a lot of trouble sleeping at night throughout the duration of the film.

However, since the making of the film, Reynolds has tried to find peace again at home after a failed attempt to vacation on a beach. He said the sand was just a reminder of the box he had been in while filming (which was full of sand), so he found himself on the next flight home.

Canon Sued for Infringing Noise-Reduction Camera Patent ...

On Friday, September 21, 2012, Canon, Inc. (NYSE: CAJ) was sued for patent infringement by?Yama Capital, LLC, which is a limited liability company organized under the laws of the State of Delaware. ?The complaint, which alleges Canon infringes?U.S. Patent No. 6,069,982 (?the ?982 patent?) was filed in?the U.S. District Court for the Southern District of New York. ?The ?982 patent was issued on May 30, 2000, and the original owner was Polaroid Corporation. ?This caught my eye because I am presently enrolled in a basic photography class with the hope of being able to do better than point, shoot and pray.

In the complaint Yama asserts that they are the assignee and owner of the patent, which generally discloses and claims technology to update default data and parameters relating to spatial noise characteristics in a digital image acquisition system. ?Of course, the digital image acquisition systems at issue are various Canon digital cameras.

The Yama complaint also includes a section relating to Canon?s knowledge of the ?982 patent, saying that ?Canon cited the ?982 patent in U.S. Patent No. 6,489,973 demonstrating knowledge of the ?982 patent at least as of 2002.? ?The complaint also goes on to point out that the patent was sent to Canon on June 7, 2012, in order to invite licensing discussions. ?Kaora Nakamura, who is apparently in the Canon legal department, is alleged to have written to Yama?s licensing counsel on June 12, 2012, stating that the ?982 patent had been received and forwarded up the chain of command at Canon?s worldwide headquarters in Tokyo, Japan. ?Of course, these statements about knowledge of the patent have been planted to attempt to demonstrate willful infringement, and perhaps later to attempt to argue that this case is exception and warrants attorneys fees. ?Of course, Yama will first need to prevail.

In terms of the technology allegedly infringed, the lawsuit alleges that Canon infringed on the patent by including the underlying technology covered by the ?982 patent in the following Canon digital camera models:?EOS-1D X,?EOS 5D Mark III,?EOS 5D Mark II,?EOS 7D,?EOS 60D,?EOS Rebel T4i,?EOS Rebel T3i,?Powershot G1X, and?Powershot S100.

According to the complaint filed, Yama believes that Canon is infringing based on statements contained in the Canon EOS System Summer 2012 brochure. Specifically, the complaint asserts: ?Canon?s website boasts that its digital cameras include noise reduction that produces clear images when shooting in low light at high ISO speeds and advertises its infringing noise-reduction technology as a product differentiator.?

While the specific statements are not identified, in reviewing the Cannon brochure several statements seem clearly to be what Yama is referring to. ?These include (but are not limited to) the following Cannon statements in the brochure:

  • ?Even at higher ISO settings where one might expect to see a higher degree of noise, the renowned Canon CMOS sensor and noise reduction system work to ensure superb image?quality.
  • ?Large sensors also capture more light, and can record at high ISO sensitivities with less digital grain and reduced image noise. This enables low-light shooting, without loss of detail, in situations previously impossible without artificial light. Although many devices offer HD recording, the quality of video captured by an EOS DSLR and its CMOS sensor is markedly vibrant and truer to life.?
  • ?With the 5 Image Processor?s remarkable noise-reduction technology, the EOS Rebel T4i sets a new standard for Rebel cameras and low-light photography.?

I have been quite critical of many patent complaints because they simply?violate the Federal Rules of Civil Procedure as the Supreme Court has interpreted them most recently in?Ashcroft v. Iqbal, 129 S. Ct. 1937 (2009) and?Bell Atl. Corp. v. Twombly, 550 U.S. 544 (2007). See?Paul Allen Complaint Dismissed?and?Motorola Sues Apple with Sparse Complaint.?This complaint filed by Yama, however, shows that a complaint does not need to be very long in order to meaningfully put the defendant on notice as to what the plaintiff is alleging. Having said that, the complaint is not everything one would hope for, but certainly as much as district courts require.

The one deficiency I see in the complaint is that there is no mention of any particular claim that is infringed. In the past I have said that there is no way for a patent infringement complaint to rise above a speculative level and have enough facts to justify recovery without identifying a single claim that has been infringed, but the sad truth is that complaints that do not include that level of detail are filed all the time and without consequence. ?In this complaint, for example, Yama asserts: ?Canon has been and continues to infringe the ?982 Patent, directly and/or by intentionally inducing direct infringement by its customers and/or users by making, using, selling, importing, and offering for sale, the accused digital cameras.?

Simply stated, patents are not infringed. ?Patent claims are infringed. ?This may seem like a legal argument that is too cute by at least half, but the reality is that a complaint is supposed to be able to support the recovery asked for. If the defendant were to decide not to participate in the litigation and file an Answer and contest the allegations the complaint would still need to be legally sufficient for the district court to enter judgment. ?A complaint without the requisite allegations is not one that would support such a default judgment. ?Because patents are not infringed, but rather claims are infringed, if Canon were to ignore this litigation (which they won?t do) the district court judge should not enter a default judgment. ?There is no statement that any particular Canon model incorporates all of the limitations of any particular claim. ?You cannot infringe a patent in a vacuum. ?It is all about whether each and every limitation found in a claim is included in the accused infringing device. ?No where in the complaint is the proper assertion made.

Now I realize I am chasing windmills here, but it is truly regrettable that the Federal Circuit has not stepped in to require complaints with more information, which would be consistent with the Supreme Courts rulings in Twombly?and Iqbal. ?It certainly seems that this complaint is not one of those objectively bad, non-informing complaints. ?There is ample information to put Canon on notice as to the plaintiff?s theory, so this case has not been initiated by ambush by any stretch of the imagination. ?But there are many complaints that offer no meaningful information as to why the plaintiff believes the defendant is infringing, and they offer no information on any single complaint. ?Instead they seek to shakedown defendants and bully them into settling in what is reminiscent of the old protection rackets. ?The Federal Circuit has even explained that some of the bad actors are engaging in what appears to be ?extortion like? activities. ?One easy thing that could be done to prevent such bad actors would be to meaningfully police the requirement to put the defendant on notice mandated by the Supreme Court in Twombly?and Iqbal.

The requirements for what goes into an adequate patent infringement complaint are really as clear as mud, thanks to conflict between the Supreme Court?s latest pronouncements in Twombly and Iqbal?and the Federal Rules of Civil Procedure. ?There is a model complaint for patent infringement actions that is attached to the Federal Rules of Civil Procedure.? It was obviously created by someone who knows nothing about patents or patent infringement, because all that is required is that the plaintiff assert the title of the patent and sanctions the provision of no useful information. ?Notwithstanding, it is the Supreme Court that will be the final arbiter of whether the model complaint is appropriate ? eventually???and given its recent jurisprudence it seems pretty clear that the Supreme Court is less than thrilled with the lack of substance in federal complaints. ?The trouble with non-informing complaints is that bringing a lawsuit is made easier, thereby shifting the burden of due diligence onto the defendant without any reasonable or articulable belief there has been any wrongdoing on the part of the defendant.

Protesting Libyans overrun militant compound

Updated 9:08 a.m. ET:?An Islamist militia was driven out of the city of Benghazi early on Saturday in a surge of protest against the armed groups that control large parts of Libya more than a year after the overthrow of Moammar Gadhafi.

A spokesman for Ansar al-Shariah said the group had evacuated its bases in Benghazi "to preserve security in the city."?

In a dramatic sign of Libya's fragility, the crowd swept through the base and?went on to attack a pro-government militia, believing them to be Islamists, triggering an armed response in which at least 11 people were killed and more than 60 wounded, according to Reuters.

Ansar al-Shariah is the militant al-Qaida inspired group that some allege played a role in the Sept. 11 attack on the U.S. Consulate in Benghazi that left four Americans dead, including U.S. Ambassador Chris Stevens.

The invasion of its compound, which met little resistance, appeared to be part of a coordinated sweep of militia bases by police, government troops and activists following a mass public demonstration against militia units in Benghazi on Friday.?

Demonstrators pulled down militia flags and set a vehicle on fire inside what was once the base of Gadhafi's security forces who tried to put down the first protests that sparked last year's uprising.

Hundreds of men waving swords and even a meat cleaver chanted "Libya, Libya," "No more al-Qaida!" and "The blood we shed for freedom shall not go in vain!"?

"After what happened at the American consulate, the people of Benghazi had enough of the extremists," demonstrator Hassan Ahmed said. "They did not give allegiance to the army. So the people broke in and they fled.?

As parts of the Muslim world fire up with anti-American protests, thousands rally to support America in Benghazi, Libya, where the U.S. ambassador and three others were killed a week earlier. NBC's Brian Williams reports.

'Benghazi will be your inferno!'
Adusalam al-Tarhouni, a government worker who arrived with the first wave of protesters, said several pickup trucks with Ansar fighters had initially confronted the protesters and opened fire. Two protesters were shot in the leg, he said.?

"After that they got into their trucks and drove away," he said. Protesters had freed four prisoners found inside, he said.?

Continuing to chant anti-Ansar slogans, the crowd, swelling into the thousands, moved on to try to storm a separate compound where the powerful pro-government Rafallah al-Sahati militia was entrusted with guarding a big weapons store, and opened fire on the assailants.

Looters carried weapons out of the compound as men chanted: "Say to Ansar al-Shariah: 'Benghazi will be your inferno!'"

Officials at three hospitals told a Reuters correspondent they had a total of five dead and more than 60 wounded from the night's violence.

A trail of blood near two abandoned cars led police to six more dead bodies near the Rafallah al-Sahati compound on Saturday morning, police officer Ahmed Ali Agouri said.

"We came as peaceful protesters. When we got there they started shooting at us," student Sanad al-Barani said. "Five people were wounded beside me. They used 14.5 mm machineguns."

After Libya, renewed questions about al-Qaida?

The withdrawal of Ansar al-Shariah across Benghazi and the huge outpouring of public support for the government suggests an extraordinary transformation in a country where the authorities had seemed largely powerless to curb the influence of militia groups armed with heavy weapons.

Nevertheless, Ansar al-Shariah and other Islamist militias have bases elsewhere in eastern Libya, notably around the coastal city of Derna, known across the region as a major recruitment centre for fighters who joined the wars in Iraq, Afghanistan and Syria.?

'No to militias'
The militias, a legacy of the rag-tag popular forces that fought Gadhafi's regime, tout themselves as protectors of Libya's revolution, providing security where police cannot. But they now face public criticism and are accused of acting like gangs, detaining and intimidating rivals and carrying out killings.?

The government heavily depended on Rafallah Sahati, for example, to secure Benghazi during the country's first national elections in July in decades. The militia took its name from an Islamist fighter who battled fiercely against Gadhafi's forces earlier in the revolution.

But most of Libya's militias still answer to their commanders before the state. Protesters, like those on Friday, want the fighters to be trained outside Benghazi and follow state army orders as individual soldiers and not as part of a militia. Many of the militiamen are unruly and undisciplined civilians who raised arms during the eight-month war.

Mohammed al-Megarif, head of Libya's General National Congress, ordered protesters to leave alone militias that are "under state legitimacy, and go home." Nearly seven hours of clashes ended shortly after his demand that was broadcast on local Libyan TV channels.?

Although the main demands of the marchers on Friday did not mention the attack on the U.S. Consulate, it seems to have provided a strong impetus for the authorities to rally support behind the country's weak government.

Some protesters carried signs reading "The ambassador was Libya's friend" and "Libya lost a friend," the AP reported.

"I don't want to see armed men wearing Afghani-style clothes stopping me in the street to give me orders, I only want to see people in uniform," said Omar Mohammed, a university student who took part in the takeover told AP.

We know sitting at a desk all day is bad for us. But not everyone has a company gym membership or a workweek that allows for morning and afternoon fitness classes. So here are six stretches that loosen the muscles made most stiff by sitting. No gym equipment or extended lunch hours required!

1. Neck and Shoulders. Hunching over keyboards strains the cervical spine and stiffens our shoulders. On the next bathroom break, reach your arms behind you, and interlock your fingers so that your palms face. Lift your arms so you feel a stretch in your chest and front shoulders. Draw your chin down to avoid crunching the neck. (Of course, feel free to do this at your desk. Tell anyone who gawks to follow suite.)

2. Hip Flexors & Iliopsoas. These muscle groups are at an especially high risk of tightening after long days at a desk. Here?s a morning and after-work stretch to keep ?em lengthy. Kneel on the floor (top of the shins and feet as your base, torso straight). Pick up your left leg and place the left foot on the floor, keeping the knee directly above ankle. Keep both hips horizontally aligned as you move your torso toward the wall in front of you, gliding the knee forward. You may feel a stretch in your calf and Achilles. From the original hip flexor stretch (low lunge, left foot forward, right knee and shin on the floor) reach your left arm to your side and touch the fingers to the floor or stack of books for support. Curve your right arm over your head reaching the right fingertips over the left side of your body. Hold for 20 seconds. Breathe. See if you can stretch a bit further, then return to a straight spine. Switch legs and repeat on the other side.

5. Lower Back & Lats. Sitting for too long rounds out our spine in all the wrong places. The muscles surrounding the lumbar spine get particularly weak while the hamstrings can go slack. Lie on your stomach on the floor or on a mat. Hard version: Lift your legs off the floor. Easy version: Keep the legs on the floor. Bend your elbows and interlock your fingertips behind your neck (thumbs on either side of your neck, pointing towards your upper back). Lift your chin, look ahead. Inhale while lifting your torso as far off the floor as you can, albeit gently, by tightening the muscles along your spine. Lower down on an exhale. Repeat 10 to 15 times.

Now bend your knees and sit back on your heels (tops of the feet still touching the floor). Rest your torso on your thighs and your forehead on the floor or a pillow. Reach your arms out in front of you, walk the fingertips forward and retract the shoulder blades down the back. Keep your butt on your heels as you pick up your forehead and walk your hands over to the left, then to the right to throw in a lat stretch.

6. Whole Back/Spine & Hamstrings. De-stress your spine after it?s been chair-bound all day. Lie on your back, feet on the floor, knees bent. Draw both knees into the chest and gently rock. Then extend the left leg straight on the floor as you keep the right knee hugged towards the chest. Take a few breaths here and enjoy the hamstring stretch. Then, keep your right shoulder on the floor and guide the right knee across the midline of your body, towards the floor, with your left hand. It?s okay if your knee doesn?t touch the floor. Stop if you feel any pain at all. After 30 seconds, draw that knee back to center. Switch legs and repeat on the other side.
