Seniors: Who's Managing Your Debts? | Credit.com News + Advice

Fran Hansen seemed to be doing just fine. She had a mortgage and credit cards, and she ?never missed a payment? on any of her cards and always ?paid my mortgage on time faithfully!??a Credit.com reader using the screen name Fran Hansen said in a recent comment to the blog.

But Hansen?s children were worried. Their mother may have been making all of her payments, but her debt was high, with about $25,000 owed on multiple credit cards. With the average interest rate on credit cards at almost 17 percent, that meant Hansen was spending a sizable chunk of money every month simply paying the interest.

So her children took drastic measures. They enrolled Hansen with a credit counseling company, and they took away her credit cards. Now Hansen?s bills are paid in a lump sum every month, and the credit counseling company parcels it out to her various creditors.

[Credit Score Tool: Get your free credit score and report card from Credit.com]

Free Credit Check ToolBut there appears to be a problem. One of her creditors sent her an email reminder saying that her payment is due.

?Is it possible they make all my payments late?? Hansen writes. ?Will I have bad credit now??

It?s easy to see why Hansen might be feeling a little out of control. From what she writes, it seems she doesn?t know exactly what?s going on. Is the bill due, or past due? Is the notification coming from the debt counseling company (which means all of her credit payments are in jeopardy), or is it from just one credit card?

Perhaps most important, if her bills are not being paid, which part of the system is breaking down? Is the problem with Hansen?s income, maybe with her bank?s computer that process the check from her employer or Social Security? Is it that her children failed to make the lump sum payment to the debt counseling company? Or maybe that the counseling company made a mistake?

?It sounds to me like she doesn?t know what?s going on,? says Charles Alkire, a financial planner who specializes in advising senior citizens. ?She needs to find out.?

[Related Article: Protect Your Elderly Relative From Credit Card Fraud]

And since the problem may be with her kids, Hansen may not be able to turn to them to straighten out. If you?re like Hansen, and problems arise while you?re relying on your children, a credit counseling company or anyone else to manage your finances, here are three steps to minimize the damage and get back on track.

1) Hire a Lawyer. For someone facing large debts, especially on a fixed income, hiring an attorney may seem an extravagant expense. But spending a few hundred dollars now could save Hansen thousands of dollars in late fees and extra interest charges later, and it also could prevent her from losing her house. Any lawyer with experience in estate planning should be able to figure out quickly whether the problem here lies with Hansen?s income, her children or the credit counseling company.

2) Fire Somebody. If the problem is that the children didn?t make the payments on time, it?s probably time for Hansen to find someone else to manage her finances. If the credit counseling company made the mistake, it?s time to find a better one, ideally one run by a nonprofit group, Alkire says.

3) Autopay. Since Hansen has enough income to pay her bills, ?this is the perfect case for autopay,? says Barry Paperno, Credit.com?s credit scoring expert. By going online to set up automated monthly payments from her bank account, Hansen will know she?ll never be late on a payment.

Midwest Drought 2012: Plains Ranchers Forced To Sell Cattle

WICHITA, Kan. (AP) ? Kansas cattleman Ken Grecian sold 20 pairs of cows and calves a few weeks after drought had sucked his pastures dry and no rain was in the forecast. He sold 20 more pairs Friday.

Grecian spent years meticulously breeding his cows to improve the genetics in each generation, but with Kansas in one of the worst droughts seen in decades, he's struggling to find enough grazing to feed 300 cows, plus their calves. He hopes to get by with selling only a quarter of his herd, but there are no guarantees with the drought expected to linger through October.

Other cattlemen throughout the middle and western part of the U.S. also are selling animals they can't graze or afford to buy feed for. Beef from the animals now flooding livestock auctions will start showing up in grocery stores in November and December, temporarily driving down meat prices. But then prices are expected to rise sharply by January in the wake of dwindling supplies and smaller livestock herds.

The number of cattle in the U.S. has been dropping for years, but the pace picked up last year when ranchers in Texas, the nation's top beef producer, sold a massive number of animals amid a severe drought in the Southwest. Farmers in Nebraska, Montana, Wyoming and the Dakotas bought some of those cows, however, so nationwide, the loss wasn't as great as it could have been. This year, virtually no one is expanding herds.

"The drought was really bad in the Southern Plains last year, but the cattle industry was able nationally to absorb it because it wasn't bad everywhere. This one is much more along the lines of bad everywhere, so the market implications are a lot larger and a lot more players in the industry are impacted by this," said Glynn Tonsor, an agriculture economics professor at Kansas State University.

The U.S. Department of Agriculture reported Friday that the nation's cattle inventory was the smallest since the agency began a July count in 1973. It estimates the size of the nation's herd each January and July. The U.S. had 97.8 million head as of July 1, 2 percent less than a year ago.

It is likely to take the beef industry years to recover. Cows have a nine-month gestation period, and it can take up to two years after calves are born for them to grow big enough for slaughter. The time needed to repair drought-damaged pastures will only extend that timetable because ranchers must have grass for grazing before they can add animals.

Grecian, 62, who farms northwest of Hays, said a local drought forced him to sell nearly 30 percent of his cattle in 2003. It took six years for him to rebuild once the drought ended. He did it by holding onto female calves and not selling them.

It's possible, he said, to rebuild faster by buying animals, but that can be costly when few young, female cows are available, and farmers might not get the animals they want.

"It is our life and we invest a lot of emotion and energy and money into developing a cow herd that is genetically what we want," Grecian said. "When we are forced to liquidate, it is not an easy thing to do. It is pretty heart-wrenching sometimes, but is part of the business."

Cattle have been streaming into auction yards across the country in recent weeks as grazing land burns up in the sun, ponds and streams evaporate and prices for feed corn rise. In Oklahoma City, the number of cattle going to auction quadrupled in one week earlier this month, and in Kearney, Neb., it increased three-fold.

In Texas, some 36,000 cattle were brought to auctions last week ? nearly triple the 13,400 animals sold just a couple of weeks earlier and approaching the 43,600 head sold at the same time during last summer's brutal drought, according to the USDA.

Calf prices are falling with so many animals on the market. A 600-pound calf now fetches $120 less than it brought in just a couple of months ago. Prices for feeder cattle, which are typically fed grass before going to feedlots to be fattened on corn, have collapsed as corn prices have gone up. Feedlots are spending about $200 more per cow on corn than they were just months ago.

Beef prices were already falling after rising 10 percent last year amid the drought in the Southwest. They peaked at an average of $5.09 per pound in January, and then came down to about $4.93 per pound in June. They are expected to increase again, but it's not clear by how much. The USDA had predicted a 2.5 to 3.5 percent increase in beef prices for the year, but that was before the drought spread and cattle selloffs mounted.

Jon Ferguson, 63, has weaned calves earlier and sold some cows about a month earlier than usual to save pasture on his ranch near Kensington, Kan. He has about 450 pairs of cows and calves and nearly 1,200 other calves that he buys each year to fatten on grass before shipping them to a feedlot.

He shipped a third of his cattle from Kansas to Colorado to graze during a drought in the summer of 1989. He's not sure whether that option will be available this year, or whether he should just liquidate and cut his costs now.

"If you can figure out a way to hang on to them at a reasonable cost until the drought is over, it typically pays you pretty well," Ferguson said. But, he added, "If this thing persists through the summer, and we see these kinds of temperatures with no significant moisture relief, we will be in trouble by fall."

NCAA penalties against Penn State, too harsh or not enough?

"I believe history should never be taken away. I believe it's important to recognize whatever is in the past and keep it. You can't just wipe it off."

Tatiana Kakun, Warrington

"I think they're appropriate. I think they should have eliminated the next season coming up. I don't think the punishment was too harsh, I think it should have gone one step further to send a message to the rest of college sports that they won't tolerate any kind of cover-up."

Dave Anthony, Croydon

"It's too bad that some of the current football team will feel the consequences, the students had nothing to do with this. Then again, the child abuse was awful, but the people in charge should have done something about it."

Elizabeth Wira, Levittown

"I think it's a bit harsh. Sandusky has committed a horrid crime and it's a terrible thing, but did the entire Penn State environment commit this crime? Does it really require removing victories? I think it's extreme.

"Sixty million dollars is not going to bring back the integrity and the honor of the kids that got violated, the NCAA is overstepping their bounds. It's ridiculous, why are they even involved?"

Lawrence Plummer

"It's affecting prospective students and students that worked really hard both academically and athletically to have a dream to play there. Now, they're the ones that will be punished. I think the NCAA was a little bit too harsh, they absolutely had to do something but I think it should have been directed more towards the people involved."

Diane Tirendi, Warrington, who has a daughter currently attending Penn State.

"Sixty million dollars is a lot of money. If they're paying that then that should be the only punishment. I think it was way too harsh, they went way over the edge."

Weekend Special: Curious Kazakh Gopher Not Curious About Nearby Spaceships

How he got to live there, I don't know. For one thing he's a gopher, not a cosmonaut or a rocket engineer, just an ordinary Kazhakh rodent who dug himself a hole. The hole, however, is smack in the middle of a rocket launching facility, one of the most active spaceports in the world, called the Cosmodrome.

Located in Baikonur, in Kazhakhstan, this is the place that launched Sputnik in 1957, sent Yuri Gagarin into space in 1961, services Soyuz with multiple launches ever year. It's busy, noisy and it's dangerous ? one would think.

But take a look at this gopher. He (she?) seems more than comfortable. Giant platforms roll overhead ? not a problem. Huge tall things loom nearby ? so what? People come close. Does he care? No. But when someone sets a camera at the entrance of his home, suddenly he's Mr. Curious.

He sticks his eyeball against the lens. He tries to chew the glass. He sniffs everywhere. Looking at him, I can't help but think "this is exactly the kind of Earthling I'd want to send to a nearby planet." He's compact. He digs. He's careful (often standing stock still, to make himself invisible), and he inspects everything.

Plus, being smaller, his spacecraft, space suit and space diet (sunflower seeds in a large bag) represent a significant cost savings...if he'd go. But he seems so happy in his hole, I wonder: Do ground-dwelling rodents ever dream of the stars?

Tomato Salad with Macadamia Cheese #Sunday Supper ...

Happy and Healthy Sunday everyone.? Today is my very first post for #Sunday Supper.? I?ve been trying to join this group for a while but I could not quite figure out what to do (must be an age issue).? Isabel the hostess of #Sunday Supper walked me through, thank you so much Isabel.? This weeks other hostess? are Jen and Linda from Juanitas Cocina.? Great job Jen and Linda and thanks for all your hard work putting together?this week?s Beat the Heat?theme supper.

Today?s #Sunday Supper is appropriately titled Beat The Heat.? Seems we are all in the middle of a heat wave, whew, is that perspiration on my brow.? Time to run through the sprinklers, I still do that and I hope that you do too.??I?do it with my grandkids. ? Yeah, I put on my granny suit, oh geez is?that woman?showing some skin.?? Okay back to the point,??I do tend to get distracted.? This week?s theme is about not heating up your kitchen and preparing foods that don?t require turning on the oven.? Makes sense to me.

I decided to make a simple chilled tomato salad with some macadamia cheese.? The dressing is a tad of olive oil drizzled over the tomatoes and a slathering of balsamic glaze.? For this salad, not a bit of heat was created in my kitchen unless you want to count the food processor and there I was the only one who got overheated just by turning it on.? Any movement can stir up some warmth with this heat.

On to this cooling salad.? I was so excited to find raw macadamia nuts at the health food store that I raced home and starting soaking them in water for the 8 hours to soften them up and forgot to take any photos.? After the soaking time I immediately put them in the food processor, no photos.? It doesn?t take a lot to get me excited.? I mean who goes over the edge for raw macadamia nuts, LOL?? This macadamia cheese is a great alternative to dairy?and if you like macadamia nuts you?will really appreciate the nutty, creamy consistency.

This is a?simple and easy raw veggie salad.? The main ingredients are tomatoes, red, yellow, green or whatever you can find.? Any other raw veggies will go well?with this salad too.? You can use spinach as a base, some arugula, cucumber, onions, live sprouts, microgreens.

The macadamia?cheese recipe is courtesy of?Candle 79,?a vegan restaurant in New York City.

8?oz raw macadamia nuts soaked

1 teaspoon sea salt

2 tablespoons nutritional yeast

1 tablespoon lemin juice

Combine all ingredients in the food processor and whir ?until smooth.

?

Whoo Hoo ? also on a day of firsts I was nominated by the sweetest blogger I know, ?Choc Chip Uru?@ Go Bake Yourself ?for the Addictive Blog Award.? Thank you so much my sweet friend.? You are the best.? I will post the rules and my selections on my next post, hopefully on Tuesday.? Just had to throw that in here.? How does one choose the most addictive blog award considering all the food I see daily.? Hmmm.

I hope everybody is enjoying a cooled down Sunday Supper.? Please check out all the other bloggers who contributed to today?s feast.? All their links are below.

What does "The Chinese have a curious take on intellectual property and retail." mean in the following article? Is it an OK thing to say?

I'm not sure if there's anything illegal in selling an iPhone 5 on taobao for delivery once it is released.? While Apple doesn't like you to resell your iPhones, once you own it, you can dispose of it however you please.? And if the seller follows through and delivers the iPhone, its hard to see how any Chinese or US laws are being violated.

The phrase "the Chinese" in that statement is either a horrific grammar mistake, or somewhat of a racist generalization.? There are over a billion Chinese people in the world, and a few people pre-selling the iPhone 5 on taobao.? If she's using those handfull of people to suggest that all Chinese people are prone to shady business dealings (in spite of the fact that she doesn't actually describe why they're shady), yeah, she's being racist.

Japan Floods From Heavy Rainfall Prompts Evacuation - NewsOXY

Rising waters from the Yamakuni River in Japan from heavy rainfall is causing more floods where at least 17 people have died, 20 are missing and 50,000 are being evacuated to higher ground, according to the country?s Meteorological Agency.

Japan Floods Evacuation

Rescuers search for missing villagers after a mudslide in Minamiaso, in Japan?s Kumamoto prefecture, which has been hit by days of heavy rain and flooding.

About 400,000 people were ordered or advised to leave their homes in southwest Japan yesterday as heavy rain pounded the area for a third day leaving 29 dead or missing, according to the Associated Press.

The Japan Meteorological Agency warned of more landslides and floods on the main southern island of Kyushu as rainfall of up to 11 centimetres per hour was recorded yesterday.

Evacuation orders were issued to about 260,000 people in the north of the island where more rivers burst their banks, Kyushu?s local media reported.

They were told to go to designated shelters such as schools and other public facilities.

Nearly 140,000 other people were advised to leave their homes to avoid possible disaster, according to officials contacted by AFP in the four affected prefectures in Kyushu.

Television footage showed torrents of muddy, debris-strewn water and flooded houses following what officials described as ?unprecedented? downpours from a seasonal rain front.

Along the Yamakuni river in Oita prefecture, water levels were seen reaching the roof of a riverside drive-in restaurant before subsiding later.

In Fukuoka prefecture alone, 78,600 people were ordered to evacuate their homes as rivers overflowed in dozens of places and 181 landslides occurred, an official said.

About 820 houses were damaged and three bridges washed away, said Fukuoka prefecture spokesman Hiroaki Aoki.

Common Good Books: TO-READ l How Should A Person Be?

Books have changed. I'm not about to launch into a treatise on the state and/or identity of modern literature (the rise of ?girlishness? as antithetical to feminism, the role of non-certified organic fruit as plot device in war novels, etc.,) but would rather like to think about the surfaces of books, the artifacts themselves. Yes,?they're pretty now, as evidenced above.?And shorter, occasionally. But too it seems that books today have far more blurbs from more great writers than ever. In fact, you might say ?it seems that books today...yada yada... than a Barnes & Noble Cafe mural full of delicious smelling renderings of Whitman and Dostoyevsky both apparently not speaking over steaming cups of iced-skim frappuccinos. Or, you know, positing something brilliant, in just a second. And that number, along with its equivalent degree of celebrity and greatness, is increasing and attributing to so-and-so all the time, as, inversely (and curiously), the former breadth of biographic information re: the author seems continually to wane. "Sheila Heti is a writer who lives in Toronto," declares the back page of?How Should A Person Be?. Good enough. And might I add, Ross Vanbeek is an investment banker who lives in Chicago. Who is Ross Vanbeek? He's my friend, who lives in Chicago.?

Speaking of so-and-so's, I'd like to put myself in someone like Margaret Atwood's shoes for one devilishly comfortable moment and imagine receiving in the mail a copy of a book I think I might have read and said something about on Twitter once, a while back, who knows, and then, upon turning the book over so as not to stain its cover with my coffee, spotting, sure enough, my name next to David Shield's or Stephen King's or something. Well, no, not ?Stephen King's or something,? I suppose. Unless he too was recorded, unbeknownst to him, rattling on about Shiela Heti during one of his now infamous 10 minute, twice daily breaks from writing for a cigarette and chance to sing the praises of Canadian literature from the vertiginous third story of his surely haunted house. Which might be fitting. For as readers will, I predict, be impatient to discover, Sheila Heti, author and protagonist of a book Miranda July calls "A new kind of book," spends a great deal of her ?new book? tape recording conversations between her and her real-life friends, in effort to expose herself, it seems, to who she is, or should be, in the moment, in relation to or as a product of the people who her friends already are, without a doubt in Heti's self-consciously encumbered mind. A mind and "posture," if you like, engaging some critics to chastise Heti's heady prose as nothing more essentially, and contradictorily, than that of an?unaware, self-congratulatory hipster in a sandwich board, advertising her unique brand of irony or precocity while lying on a beach chair. Such responses to a fictionalized memoir of this size, by which I mean not page numbers or (clearly) supplemental information about?the book like, say, its author, but said author's unparalleled daring and audacity as less a creative writer than a writer of admission, seem entirely to miss and miss out on what she's up to.?How Should A Person Be?, like Wes Anderson's mostly mis-regarded films, isn't untouchably precious, but in true awe of itself, attempting to maintain a balance not of charm backed by indifference, but of ugliness anticipated and experienced, endured by hardship; traits Heti's Jungian analyst (please, let's save our eye roll for a less ambiguous author we can collectively throw up on with some confidence) assures her are unique only insofar as one's life can be called unique by virtue of its being, foremost, meaningful.?

But for the sake of argument, Slate Magazine, who among us hasn't postured for life's camera? Like earlier this afternoon, for instance, I pretended to be listening as Joe relayed the history of the American alternative rock band Yo La Tengo. "Yo-yo whata?" I remember thinking at one point, "Like the kids show?" Briefly, in-between thoughts to myself of what I might enjoy for lunch, yo-yos, and what I should be doing with my hands, so as not to unintentionally express disappointment in the band's early '90s move to Matador Records.

Perhaps, as Martin pointed out, after reproaching my decision to read a book about and (arguably) for?young women, like a father hurt and confused by his son's decision to play tap dance, hostility toward Heti's book has more to do with the book's difficulty, especially in terms of being put into a category. However, I will say that How Should A Person Be?, contrary to winding me into a ball of dread, as one might understandably assume, made me laugh?out loud on nearly every other page, as if adhering to a timer set for watering tomatoes. And yes, per usual, I was alone. And so, once again it seems the funniest books are rarely shelved in HUMOR, the most direct most often absent from NONFICTION. By the way, while I've just now jeopardized how seriously you'll take this, click here for more on our New and Improved Nonfiction Section! So, in summation, thank heavens for blurbs! Can you appreciate how at once dull and fraught with indecision buying books was in the past, with just a picture of some author and an excerpt of their writing? As if that would seal the deal! Imagine you this time, single at a bar in South Minneapolis, flirting by default with the man or woman three stools to your right. Do you seek first the opinion of your best friend/literary genius at your side, or take it straight from the horse's mouth of the guy/girl out in public wearing Vibram FiveFingers? Done and done.

Justin Bieber vs. Paparazzi: Who's to Blame for High Speed Chase?

It's time to play the blame game.

As most celebrity gossip followers likely know by now, Justin Bieber was pulled over by Los Angeles patrolmen last Friday because he was speeding along the 101. It was merely the young star's latest brush with the highway law, too.

But multiple witnesses confirm the paparazzi were all over Bieber's car, with Justin himself dialing 911 not long after his ticket and doing whatever possible to alert authorities to the situation.

Justin Bieber, All Smiles

"This was like a Princess Diana situation," a California Highway Patrol insider told TMZ of the incident, referring to the 1997 tragedy in which the royal beauty's limousine crashed and she died while trying to elude photographers. "It was not Bieber's fault."

HOWEVER, others inside the department do cite Bieber's irresponsible actions, telling the site he could have simply gotten off the freeway.

"It's like rushing a woman to the hospital who's about to give birth," said a source. "You can't endanger the lives of innocent people, and Bieber did."

Whose side are you on in this blame game?

Land tax bill concern may result in tweaks | Bangkok Business Brief

The Finance Ministry is concerned the proposed land and building tax bill could be seen as a tool to help the rich and punish the poor, says the Fiscal Policy Office.

Director-general Somchai Sujjapongse

Bangkok Post

Director-general Somchai Sujjapongse said such a perception could derail the long overdue draft, under development for more than two decades.

The land and building tax bill was brought to parliament by the Abhisit Vejjajiva government but was not passed due to an early House dissolution.

Finance Minister Kittiratt Na-Ranong expressed his support for the bill early last month but asked the ministry to make some changes before it is sent for debate in parliament.

Although the bill, which imposes a higher tax rate for undeveloped land, is aimed at curbing land speculators, Dr Somchai said the rates under the new draft could be lower than those currently applied.

The current land and property tax bill imposes a tax rate of 12.5% of annual rent. The new bill proposes a rate of 0.05% based on the value of land and buildings on farmland, 0.1% for residential land and 0.5% for land used for commercial purposes.

?This means owners of big department stores or large-scale hotels could end up paying less in taxes under the new bill while the general public _ homeowners or farmers _ will pay a small tax after paying none before,? said Dr Somchai.

Currently, land that is not rented isn?t taxed, so farmers or landowners without much assets don?t?

Does being an intense mother make women unhappy?

ScienceDaily (July 5, 2012) ? Does being an intense mother make women unhappy? According to a new study by Kathryn Rizzo and colleagues, from the University of Mary Washington in the US, women who believe in intensive parenting -- i.e., that women are better parents than men, that mothering should be child-centred, and that children should be considered sacred and are fulfilling to parents -- are more likely to have negative mental health outcomes.

The work is published online in Springer's Journal of Child and Family Studies.

Parenting can be quite challenging and requires wide-ranging skills and expertise -- a big task. Many women idealize parenthood as one of the most fulfilling experiences in life. However, some research suggests that parenting may be detrimental to mental health. For example, women have reported that taking care of their children is more stressful than being at work. There have also been suggestions that intensive parenting can result in increased stress and guilt, particularly for women. This discrepancy is known as the parenthood paradox.

Rizzo and team looked at whether intensive parenting in particular, rather than parenting per se, was linked to increased levels of stress, depression and lower life satisfaction among 181 mothers of children under 5 years old. Using an online questionnaire, the authors measured to what extent mothers endorsed intensive parenting beliefs: mothers are the most necessary and capable parent; parents' happiness is derived primarily from their children; parents should always provide their children with stimulating activities that aid in their development; parenting is more difficult than working; a parent should always sacrifice their needs for the needs of the child.

Overall, the women were satisfied with their lives but had moderate levels of stress and depression. Approximately 23 percent had symptoms of depression. Negative mental health outcomes were accounted for by women's endorsement of intensive parenting attitudes. When the level of family support was taken into account, those mothers who believed that women are the essential parent were less satisfied with their lives; those who believed that parenting is challenging were more stressed and depressed.

The authors conclude: "If intensive mothering is related to so many negative mental health outcomes, why do women do it? They may think that it makes them better mothers, so they are willing to sacrifice their own mental health to enhance their children's cognitive, social and emotional outcomes. Occupy protestor's tweets must be shared: judge

4 hrs.

A New York judge has ordered Twitter to hand over tweets and account information connected with an Occupy Wall Street protester arrested last fall during a march on the Brooklyn Bridge.

Criminal Court Judge Matthew Sciarrino, who is overseeing the hundreds of criminal cases stemming from Occupy-related arrests, rejected the idea that Twitter would violate protester Malcolm Harris' privacy by turning over the information.

"If you post a tweet, just like if you scream it out the window, there is no reasonable expectation of privacy," the judge wrote in his decision. He said he would review the information himself and release relevant portions to both prosecutors and Harris' lawyer.

The Saturday ruling, released on Monday, marks the second time in three months that Sciarrino has rejected an attempt to quash a subpoena in the case.

Prosecutors from the Manhattan district attorney's office have been seeking Harris' tweets from September to December, saying the posts demonstrate he knew police had ordered protesters not to walk on the bridge's roadway.

Defense lawyers for some of the 700 Occupy members arrested during the October 1 march have suggested that police appeared to escort them onto the bridge before taking them into custody.

Twitter spokeswoman Carolyn Penner said the company was disappointed by the ruling and would consider its legal options.

"Twitter's Terms of Service have long made it absolutely clear that its users 'own' their content," she said in an emailed statement. "We continue to have a steadfast commitment to our users and their rights."

In April, Sciarrino found that Harris, a Brooklyn-based writer, lacked standing to fight the subpoena because his information belonged to Twitter. The company then filed its own motion to quash on behalf of Harris.

Twitter's motion indicates a willingness to stand up for the rights of a member, as protesters around the world have used the service to organize their efforts in recent years. In March, a judge ordered Twitter to hand over information about an account police said was indirectly tied to the Occupy Boston movement.

Daniel Alonso, Manhattan's chief assistant district attorney, said in a statement that prosecutors were pleased by the latest ruling and "look forward to Twitter's complying and to moving forward with the trial."

Martin Stolar, Harris' lawyer, said he was considering whether to appeal, saying Sciarrino should not use what he termed "pre-21st century law" to evaluate issues of modern technology.

Sciarrino said the request for data did not violate Harris' privacy rights and that the Stored Communications Act governing disclosure of electronic data protects only private communications.

"The Constitution gives you the right to post, but as numerous people have learned, there are still consequences for your public posts," he said. "What you give to the public belongs to the public. What you keep to yourself belongs only to you."?

Law enforcement agencies in the United States are behind the overwhelming majority of requests for Twitter users' private information, the social media company revealed Monday in its first ever public report on the subject.

Of the 849 total government requests for user information during the period spanning January 1 to June 30 this year, 679 ? or 80 percent ? took place in the United States, typically for use in criminal investigations, Twitter said.

Japan was in second place after the United States with 98 requests filed by police, followed by 11 requests from law enforcement agencies in the United Kingdom and the same number from agencies in Canada.

Twitter, which was credited last year for fueling social unrest, from revolutions in the Middle East to Occupy protests in U.S. cities, has increasingly been pulled into criminal prosecutions as it gains popularity as an often-anonymous broadcast network.

The company, which published the data in a blog post on Monday, also revealed it had received a total of six governments requests over the past half-year to remove tweets that violated court injunctions or local laws, such as anti-defamation statutes.

Twitter also received a total of 3,378 copyright takedown notices, the company said.

Company promises flights to the moon aboard recycled Soviet space station

The moon may soon be a tourist destination for millionaires with Excalibur Almaz, a British spaceflight firm, preparing to sell $150,000 tickets aboard a 1970s Soviet space station retrofitted with new thrusters

The spaceflight firm Excalibur Almaz estimates that it can sell about 30 seats between 2015 and 2025, for $150 million each, aboard moon-bound missions on a Salyut-class space station driven by electric hall-effect thrusters.

Excalibur Almaz founder and chief executive officer Art Dula estimates it will take 24 to 30 months to develop the remaining technology needed and to refurbish the ex-Soviet spacecraft and space stations the company already owns. It bought four 1970s-era Soviet Almaz program three-crew capsules and two Russian Salyut-class 63,800-pound (29,000 kilograms) space station pressure vessels.

Declaring that he is ready to sell tickets and that a 50 percent return on investment could be achieved in three years, Dula told the Royal Aeronautical Society's third European space tourism conference on ?June 19, "At $100 million to 150 million [per seat, we can sell] up to 29 seats in the next 10 years, and that is a conservative estimate. We [chose] not to use, for this presentation, the aggressive estimates." ?[Gallery: Private Space Stations of the Future]

Those conservative and aggressive estimates are from a market study entitled "Market analysis of commercial human orbital and circumlunar spaceflight" carried out for Excalibur Almaz by the management consultancy Futron. In 2009, Excalibur Almaz officials told SPACE.com the company's first flight would be in 2013.

Recycling spacecraft

The architecture for the lunar mission involves a Soviet Almaz Reusable Return Vehicle (RRV), which can carry three people, launched by a Soyuz-FG rocket. This rocket also launches Russia's Soyuz manned capsule. The RRV weighs 6,600 pounds (3,000 kg) and has a habitable volume of 159 cubic feet (4.5 cubic meters). The lunar flight also uses a Salyut-class 63,800-pound (29,000 kg) space station that is launched by a Proton rocket. While Excalibur Almaz intends to use the Soyuz-FG and Proton initially, Dula did not rule out using other rockets, including Space Exploration Technologies' (SpaceX) Falcon 9 in the future. Dula said Excalibur Almaz would wait for the Falcon 9 to accumulate enough flights that it became feasible to insure the space station module aboard the rocket.

?"Our customers are private expedition members and I think it is fundamentally different to tourism," Dula said. "What we are offering [with the lunar flight] is more like expeditions."?

Once in orbit, the station and RRV will dock and the station's propulsion system, which is a group of electric hall-effect thrusters, propels the stack out to the moon. Excalibur Almaz is in talks with Natick, Mass.-based Busek Space Propulsion to develop the hall-effect thrusters needed. Dula described an electric system for the station module that would use up to 100,000 watts of power for its thrusters. If a solar or cosmic radiation event threatened a flight's crew and passengers, the company could run power through "electrical lines around the station and keep most of the charged articles away ? protons you can keep out with an electrical field." He also said the station would have a refuge area crew and passengers could use to protect against radiation storms.
